Welcome to SmartPhoto. By downloading, accessing, or using SmartPhoto ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Please read these Terms carefully. They contain important information about your rights, obligations, and limitations when using SmartPhoto.
1. Acceptance of Terms
By installing, accessing, or using SmartPhoto, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you ("User") and SmartPhoto ("we", "our", or "us").
If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
SmartPhoto provides AI-powered photo editing tools and local editing capabilities, including but not limited to:
- Local editing tools: Crop, rotate, resize, filters, adjustments, format conversion, and GIF/WebP frame extraction — all processed entirely on your device.
- AI-powered features: Background removal, object removal, photo repair, headshot generation, and style transfer — processed via cloud-based AI inference.
- Image compression and conversion: Tools to compress, resize, and convert between JPEG, PNG, WebP, and GIF formats.
The App is provided "as is" and we reserve the right to modify, update, or discontinue features at any time without prior notice.
3. User Responsibilities
As a user of SmartPhoto, you agree to:
- Own your photos: You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to edit and process all images you use with the App.
- Not misuse AI features: You agree not to use AI-powered features to create, generate, or process content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or infringes upon the rights of others.
- Comply with applicable laws: You agree to use the App in compliance with all applicable local, national, and international laws and regulations.
- Not reverse engineer: You agree not to reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except as expressly permitted by applicable law.
- Not interfere: You agree not to interfere with or disrupt the operation of the App or servers used to provide the App.
We reserve the right to suspend or terminate your access to the App if you violate these Terms.
4. AI-Generated Content
SmartPhoto uses artificial intelligence models to process and enhance images. You acknowledge and agree that:
- Results may vary: AI-generated results are based on machine learning models and may not always produce accurate, desired, or consistent outcomes. We do not guarantee the quality, accuracy, or suitability of AI-generated content for any specific purpose.
- Not guaranteed for official documents: AI-generated headshots, ID photos, passport photos, or any other content should not be submitted for official, legal, or government purposes unless independently verified. SmartPhoto is not responsible for any rejection, delay, or issue arising from the use of AI-generated content in official contexts.
- No professional advice: The App does not provide professional advice of any kind, including legal, medical, or photographic advice.
- User discretion: You are solely responsible for evaluating the suitability of AI-generated results for your intended use.
- Content reporting: You may report AI-generated results that you believe violate our content policies using the in-app report feature. Reports include the AI feature used, your selected reason, optional details, and the generated result URL (if available). Your input photo is not included in reports. Reports are reviewed for safety compliance and may result in content removal or account action.
Important: Results from AI features may contain artifacts, inaccuracies, or unexpected modifications. Always review AI-edited images carefully before using them for important purposes.
5. In-App Purchases and Subscriptions
SmartPhoto offers optional in-app purchases processed through Google Play Billing.
- Credit packs: One-time purchases of AI credits (7, 30, 120, or 360 credits). Purchased credits never expire and remain in your account indefinitely. All credit accounting is server-authoritative via Firebase Firestore — your balance reflects the server state, not local device storage.
- Monthly subscription (SmartPhoto Premium): A recurring subscription that grants 30 credits per billing period, ad-free browsing, watermark-free saving, and ultra-HD output. Subscription credits expire after 10 days if unused. Subscription entitlements (ad-free, watermark-free, ultra-HD) are active only while the subscription is active. Canceling or allowing the subscription to expire removes these entitlements.
- Ad-Free (Lifetime): A permanent one-time purchase that removes all ads and enables watermark-free saving. This entitlement is permanent and survives subscription changes. It does not include ultra-HD output.
- No refunds after delivery: All purchases are final once credits or entitlements have been delivered to your account, except as required by applicable consumer protection laws.
- Transactions handled by Google Play: All payments are processed securely through Google Play Billing. We do not collect or store any payment card information. Purchase verification is performed server-side by Firebase Cloud Functions — the client never directly modifies credit or entitlement state.
- New installation credits: A new installation receives 2 free credits to try AI features. These credits are non-transferable and have no cash value. Anti-farming protection prevents repeated free credit claims from the same device.
- Account recovery: A one-time recovery code is available after your first purchase. This code can transfer your paid credits and permanent ad-free entitlement to a new device or installation. Subscription credits and active subscription state are not transferable.
We reserve the right to modify pricing, credit costs, or product offerings at any time. Changes will be communicated through the App or app store listing.
6. Intellectual Property
App Code and Branding
All intellectual property rights in the SmartPhoto application — including but not limited to the app code, design, graphics, user interface, logos, trademarks, and underlying technology — are owned by SmartPhoto or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
User Content
You retain all ownership and intellectual property rights to the images and photos you process using the App. SmartPhoto does not claim any ownership over your images. We do not store, share, sell, or use your images for any purpose other than providing the services you request (e.g., temporary cloud processing for AI features).
AI Output
Subject to your compliance with these Terms, you own the rights to the edited images produced by the App. However, because AI-generated content may incorporate underlying model technology, you acknowledge that the legal framework around AI-generated works may vary by jurisdiction.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
- We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement.
- In no event shall SmartPhoto be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
- Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
- We are not responsible for any loss of data, image corruption, or damage to your device resulting from the use of the App. We recommend maintaining backups of your original images.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
8. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the App. By using SmartPhoto, you consent to the data practices described in our Privacy Policy.

Privacy First: SmartPhoto is designed to minimize data collection. Local editing tools work entirely on your device, and we do not require account creation or login.
9. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through the App or via other appropriate channels.
Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.
